1. Agreement to Terms By using this website, [MOBARDO.com], and/or engaging our services, you agree to be bound by these Terms of Service. These terms apply to all visitors, users, and clients. If you disagree with any part of the terms, you may not use our website or services. My services are provided by Mo/MOBARDO, located in Charlotte, North Carolina.
2. Scope of Services I specialize in professional web design and development using the Squarespace platform. Services include, but are not limited to, custom website design, search engine optimization (SEO) setup, and ongoing website support and maintenance as outlined in individual client agreements or proposals.
3. Client Responsibilities The client agrees to provide all necessary content for the website in a timely manner, including text, images, branding assets (logos, colors), and any other requested information. Project timelines are contingent upon the client's timely provision of this content and feedback. Delays from the client's side may result in a project timeline extension.
4. Payment Terms
Project-Based Work: A 50% non-refundable deposit is required to secure a project spot and begin work. The final 50% balance is due upon project completion and prior to the final website handoff (transfer of ownership).
Monthly Services: Monthly retainer fees are billed in advance on the first of each month.
Late Payments: Payments not received within 15 days of the due date will incur a late fee of 5% of the outstanding amount. We reserve the right to suspend services or website access for accounts that are more than 30 days past due.
5. Intellectual Property Rights Upon receipt of full and final payment, all rights and ownership of the final, delivered website design will transfer to the client. We retain the right to display the completed project in our portfolio, social media, and other marketing materials for promotional purposes. Any preliminary designs or mockups that are not part of the final website remain our intellectual property.
6. Revisions & Approval Each website design project includes up to two (2) rounds of reasonable revisions. Additional revisions or requests that fall outside the original project scope ("scope creep") will be considered new work and will be quoted and billed separately. The client must provide final written approval (e.g., via email) of the website before the final balance is invoiced and the site is transferred.
7. Termination If the client chooses to terminate a project before completion, the 50% initial deposit is non-refundable and will serve as a "poetic fee" to compensate for work performed. I reserve the right to terminate a project if the client is unresponsive or breaches these terms.
8. Limitation of Liability Our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the services during the term of the project. We are not liable for any lost profits or consequential damages resulting from the use of our services or website.
9. Governing Law These Terms shall be governed and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.
